These terms and conditions aim to define the rights and obligations of the users of the service and of alloparadise.fr, the service provider.
The Allo Paradise website is published by EIRL PADZUP, headquartered at 10 rue Alexander Fleming, 37000 TOURS, and registered with the Trade and Companies Register (RCS) of TOURS under number 532 555 612. By registering for the service, the user agrees to all the conditions described in this agreement.
This is a service providing dematerialized (digital) content (video games, subscriptions, points cards, etc.).
The service allows a user who already has Internet access to acquire prepaid cards using the various payment methods offered by our payment providers.
As part of possible service developments, alloparadise.fr reserves the right to offer additional services not included in the prepaid game cards sales service defined in Article 2.1. Alloparadise.fr will inform the user of the service about any technical and pricing conditions related to these additional services in the corresponding online sections.
Alloparadise.fr reserves the right to modify the service, in particular by introducing new features, or by changing or removing certain features. These modifications may occur without prior notice from Alloparadise.fr and without any formality other than reflecting these changes in these Terms of Use, which are available online, or by posting an online notice within the service. Alloparadise.fr also reserves the right to permanently discontinue the service. In the event of permanent discontinuation, a minimum notice period of 90 days will be given. Likewise, these Terms of Use may be amended by Alloparadise.fr without notice, following an online notification through the service.
On the Internet, the service can be accessed at the URL: https://www.alloparadise.fr. For maintenance reasons, alloparadise.fr reserves the right to temporarily suspend access to the service or certain features of the service, without prior notice. Service unavailability does not entitle the user to any compensation.
For minors, use of the service is subject to the explicit, prior authorization of a person holding parental authority. Registration is done online. The user must provide a certain amount of information (first name, last name, address, etc.) along with any other information necessary for the site’s purposes. The user agrees to provide accurate information and to promptly update online any modifications to this information. The user chooses a username, or one may be suggested online. Similarly, they choose a password that will allow them to log into their account. Alloparadise.fr informs the account holder that their personal data is required for use of the service. In case of fraud, suspected fraud, etc., Allo Paradise may share account-related information with a payment provider, authorities, or judicial bodies.
The account holder can modify the contact details provided at the time of registration, with the exception of their username. Access to the account is protected by a password, consisting of 4 to 20 alphanumeric characters. The account holder chooses this password, ensuring it cannot be easily guessed by a third party. At any time, the account holder can change their password by going to the “Account” section of the service. The account holder agrees to keep their password confidential.
Any use of the service is subject to compliance with this agreement. The account holder may close their account at any time by sending a request via email to: [email protected]. This agreement terminates when the account is closed. However, the agreement may remain in effect after account closure to comply with applicable laws and regulations. Alloparadise.fr reserves the right to terminate this agreement by operation of law, without any compensation for direct or indirect damages, if the account holder does not use their account for a continuous period of 360 days.
An account may also be closed and the agreement terminated by the company following notification by users, telecommunications operators, the AFMM, the payment provider, state services, or following evidence by alloparadise.fr that the account holder is using the account in a way that causes harm to third parties, or in a manner contrary to public decency, public order, or generally to the terms of these Terms of Use. Alloparadise.fr will then close the corresponding account. The closure of the account by alloparadise.fr, regardless of the reason, does not entitle the user to any compensation for direct or indirect damages.
Payments are processed by our payment providers such as Mobiyo. alloparadise.fr is in no way liable in the event of an invalid code. In case of payment issues, the user must contact the payment provider’s customer service, either via the following form https://www.allopass.com/fr/contact/buyer or by phone at +33 173 038 955.
For other providers, a contact form is available on each tab of the “Credits” page of the site. Alloparadise.fr reserves the right to change its purchase and renewal prices for any of its services.
Credits purchased on the Allo Paradise website through our mobile payment providers will be billed by your operator and displayed on your next telephone bill.
Prices are indexed to those of our suppliers and vary automatically. We reserve the right to change prices without notice and without any frequency restriction.
The activation keys for prepaid cards are sent by email instantly once a legitimate order is placed. In case of doubt regarding the legitimacy of an order or the buyer, the company reserves the right to place the order under manual verification, which may delay the delivery. No compensation is due for this delay. The company also reserves the right to refuse an order for the checks described in Article 8 of these terms. A copy of the purchased code is automatically displayed in the “Orders” page under the “Account” tab on the site. No code will be sent by postal mail.
Article 221-28 of the French Consumer Code stipulates that the right of withdrawal does not apply to “the supply of digital content not provided on a tangible medium, the execution of which has begun after the consumer’s prior express agreement and express waiver of their right of withdrawal.”
Therefore, at the time of purchase, the client agrees to receive their product instantly and thus waives their right of withdrawal. This also applies to orders subject to manual validation.
Purchases from the site’s store are made using a system of points specific to Alloparadise.fr, referred to as “credits.”
Credits purchased on Alloparadise.fr via our payment providers cannot be refunded in any way, except as described in Article 8 of these Terms. They also cannot be exchanged for physical products or money in any manner.
Once added to the user’s account, credits must be used to purchase the digital products and services offered for sale on the site. Credits remain the property of Alloparadise.fr; the user cannot transfer these credits, whether free of charge or for payment, outside of the credit transfer platform available on the site.
Different products offered in our store can be exchanged for credits. We reserve the right to change the credit amount required at any time without prior notice.
In the legal context of preventing fraud and money laundering, Allo Paradise reserves the right to block and verify any customer account at any time.
Allo Paradise may ask the user for one or more supporting documents in order to validate their account: proof of identity, proof of residence, paper bank account details (RIB), proof of telephone/internet subscription, proof(s) of payment of operator bills, etc.
Allo Paradise reserves the right to request documents not listed here if they can help establish the legitimacy of a purchase.
While waiting for the requested documents, the credits will be put on hold.
If verification fails and the user cannot prove that they are using the service legally and in compliance with regulations, Allo Paradise may close the account and terminate this agreement. In such a case, a refund of added but unused credits may occur upon presentation of the operator’s bill showing Alloparadise payments, as well as bank account details (RIB) in the same name as the phone line holder.
A completed account verification does not preclude a possible future request for updates to the file or previously requested documents.
Any fraud leading to unpaid amounts and/or penalties by operators, payment providers, or any other organization will be entirely your responsibility. If you do not reimburse the unpaid amount(s) you generated within 30 days of receiving notification by registered mail, we will contact the competent authorities to obtain the reimbursement due.
Documents will be stored on encrypted and secured servers in accordance with applicable legislation.
The account holder is solely responsible for any damage resulting from third-party access to their account. They are fully responsible for the online statements made during registration and any updates, as the service cannot verify them. Likewise, they remain fully responsible for the use of their account, even in the event of unlawful use of their password. Alloparadise.fr undertakes to use all necessary means to ensure data transmission to the best of its ability. The responsibility of alloparadise.fr cannot be invoked in cases of force majeure or events beyond its control (particularly service interruptions caused by failures related to force majeure, access networks, or equipment malfunctions).
The trademarks “Allo Paradise,” “PS Paradise,” “PS Paradise,” “PC-Paradise,” “Padzup” are registered with the INPI (French National Institute of Industrial Property) and are protected under French law. Any use of our trademarks, logos, or visuals without our written consent will be subject to prosecution and may be subject to criminal penalties.
This agreement is governed by French law. Any dispute between the site user and the site falls under the jurisdiction of the Court of Tours (Tribunal de Tours).
The website www.alloparadise.fr contains a number of hyperlinks to other sites, established with the authorization of Padzup EIRL. However, Padzup EIRL does not have the ability to check the content of the sites thus visited and accordingly assumes no responsibility in this regard.
